'Bierkeller' style bar 'permanently closed' amid council investigation after allegations of breaking planning permissions

An investigation has been launched after allegations that a popular Hull bar was not being used in line with the planning permission for its building.

A Hull City Council spokesperson said the owner and operator of the Princes Avenue bar had been contacted about the probe but no action has been taken yet.

The council spokesperson said: “We are looking into an allegation that this building is being used in a way that isn’t consistent with its planning permissions, we take all complaints of this nature seriously.”

Bar owner Daniel Moxon did not respond to a request to comment on the allegations and previously declined to tell LDRS the reason for closing the business.

It comes as locals said Da Bierkeller had appeared to shut down on Monday, October 24 and the business is now listed as ‘permanently closed’ on Google.

The Bavarian-style venue, which occupies the building formerly home to the Eden bar and restaurant, first opened on Friday, August 26.

It was set up as a sports bar and broadcast football matches and other fixtures and featured long wooden tables and served the stein glasses typical of bierkellers.

The council did not specify the exact nature of the allegations it is investigating at Da Bierkeller.

A change of use to a sports bar for 84 Princes Avenue, where Da Bierkeller operated from, was logged on the council’s online planning portal on Monday, August 22.

It remains unresolved.

The last planning application the council approved for 84 Princes Avenue was in May 2021, shortly before Eden took over the premises from the previous Lucca restaurant.

The application allowed for the conversion of what was then a ground floor restaurant and bar into one which also spanned part of the first floor.

It also approved two flats on the first floor of the building and a new front entrance.

The council’s spokesperson said Da Bierkeller was licensed to open until 2am.

They added they had not received any complaints related to its licence or incidents at the premises.

A Humberside Police spokesperson said it operated under a Temporary Events Notice during its first week, also allowing it to open until 2am.

Owner Mr Moxon said the bar had always stuck to the conditions of its licence while operating but did not respond to a request to comment on the planning investigation.

He added he was at liberty to close the business and the day-to-day running of it was a matter for managers and supervisors there.

The investigation into the planning allegations continues.
